Communication

Judge Poslusny's staff may be contacted by telephone, email or regular mail. Communication by fax is not permitted except with consent of Judge Poslusny. For emergent applications, parties should notify the Courtroom Deputy, Kathleen Ryan by Chambers' email or by telephone.

Parties should be guided by D.N.J. LBR 5071-1 regarding adjournment requests.

Parties should be guided by D.N.J. Local Bankruptcy Rules 7058-1, 9013-1, 9013-4 and 9019-4 regarding the submission of proposed forms of order.

Telephonic appearances:

Important: All persons are strictly prohibited from making any recording of court proceedings, whether by video, audio, "screenshot," or otherwise. Violation of this prohibition may result in the imposition of monetary and non-monetary sanctions. The Clerk of the Court maintains an audio recording of all proceedings, which recording constitutes the official record of those proceedings.

All requests for telephonic appearances before Judge Poslusny shall be arranged through CourtSolutions, http://www.Court-Solutions.com, no later than 3:00 p.m. the court day prior to the hearing. To appear telephonically, you will need to create a CourtSolutions' account. Once you establish an account, you will be able to submit your request to appear telephonically. This request will either be approved or denied by Judge Poslusny’s chambers. As long as your request is approved by chambers, you can log into your CourtSolutions' account, prior to the hearing time, and access the large orange button entitled “Open Hearing Dashboard” for your dial-in instructions. UNCONTESTED MATTERS WILL BE HEARD ON THE PAPERS.

HOWEVER, ALL CONTESTED HEARINGS, INCLUDING TRIALS AND EVIDENTIARY HEARINGS, WILL BE PRESUMPTIVELY IN-PERSON (WITH THE EXCEPTION OF CHAPTER 13 CONFIRMATION HEARINGS AND FRIDAY DISMISSAL HEARINGS).

PARTIES MAY REQUEST TO APPEAR BY TELEPHONE IN THE NORMAL COURSE. FOR GUIDANCE ON INDIVIDUAL CASES, PARTIES ARE DIRECTED TO CONTACT CHAMBERS.

Please note that CourtSolutions is not permitted on Chapter 13 confirmation days held in the courtroom.

To ensure the quality of the record, all calls must be made from quiet locations except in the most extreme emergencies. The use of CourtSolutions as opposed to another teleconference provider is preferred.

Motions

Motions:

General Procedures: Parties should be guided by D.N.J. Local Bankruptcy Rules 9013-1 through 9013-5 regarding the filing of motions, cross motions and responsive papers.

First Day Motions in Complex Chapter 11 Cases: Judge Poslusny directs the parties to notify the Courtroom Deputy, Kathleen Ryan by Chambers' email or by telephone of the need for scheduling of all first day matters.

14-Day Waiver of Stay Requests: Any request to waive the stay of an order for 14 days under R. 4001(a)(3), R. 6004(h), and R. 6006(d) must comply with D.N.J. L.B.R. 9013-1(b). Most importantly, any movant requesting waiver of the 14 day stay of the order shall bear the burden of establishing cause for the waiver of the 14 day stay provisions and shall detail the cause in its moving papers. Failure to comply with these requirements may result in denial of the Motion in toto.

Trials

Trials:

Pre-Trial Procedures: Parties should be guided by D.N.J. LBR 7016-1 and the Joint Order Scheduling Pretrial Proceedings and Trial regarding pretrial procedures. Appearance at the scheduled pretrial conference will not be required where the Courtroom Deputy has been notified of an intention to settle the matter, dismiss the matter, or to file default papers.

Discovery Disputes: Judge Poslusny schedules discovery disputes for hearing on Motion Days as listed on Judge Poslusny calendar posted to the Court's Website: www.njb.uscourts.gov.

Requests to Enter Default and Default Judgment: Parties should be guided by D.N.J. LBR 7055-1. Judge Poslusny reviews the adversary complaint with respect to which default judgment is requested and will schedule a proof hearing where necessary.

Other: Witness list and exhibits are due as set forth in the parties' scheduling order.

Fee Applications

Fee Applications:

Parties should be guided by D.N.J. Local Bankruptcy Rules 2016-1 through 2016-5 regarding the filing of fee applications.

Reaffirmation Agreements

Reaffirmation Agreements:

Parties should be guided by 11 U.S.C. Section 524 and Fed. R. Bankr.P. 4008 regarding the filing of reaffirmation agreements.

HEARINGS: Hearings are to be scheduled for motion days at 12:00 p.m. as listed on Judge Poslusny's calendar posted to the Court's web site: www.njb.uscourts.gov. However, if an attorney wishes to appear and be heard on a reaffirmation agreement, he or she may contact Judge Poslusny's Courtroom Deputy to have the matter rescheduled to 11:00 a.m. Judge Poslusny endeavors to have these matters heard first on motion days.

LEASES: Judge Poslusny does not approve reaffirmation agreements on leases. The parties may enter into a lease assumption agreement without need for Court approval.
