IMPORTANT NOTICE TO THE BAR AND PUBLIC
CONCERNING GENERAL ORDER PENDING ADOPTION OF
D.N.J. LBR 1006-1, PAYMENT OF FILING FEES IN INSTALLMENTS

Please be advised that the provisions of the attached General Order Pending Adoption of D.N.J. LBR 1006-1, Payment of Filing Fee in Installments will become effective February 1, 2016. Specifically, individuals seeking to pay the filing fee in installments must:

  • file Official Form 103A, Application for Individuals to Pay the Filing Fee in Installments, and
  • submit with the Application an initial installment payment equal to 25% of the filing fee, and
  • propose on the Application that the remaining 3 payments will each be in an amount equal to 25% of the entire filing fee.

When an Application to Have the Chapter 7 Filing Fee Waived is denied the first installment must be made within 14 days of the filed date of the petition, and be in an amount equal to 25% of the filing fee.

The Application for Individuals to Pay the Filing Fee in Installments and General Order are posted on the Court’s web site, www.njb.uscourts.gov.

GENERAL ORDER PENDING ADOPTION OF D.N.J. LBR 1006-1, PAYMENT OF FILING FEES IN INSTALLMENTS
 

Whereas, the Court has determined the need for a General Order governing the payment of filing fees in installments pending adoption of D.N.J. LBR 1006-1, Payment of Filing Fee in Installments, during the Court’s Annual Rule Making Cycle, it is hereby:

ORDERED that an individual debtor seeking to pay the filing fee in installments, must file Official Form 103A, Application for Individuals to Pay the Filing Fee in Installments, at the time of the filing of the petition. The Application must be accompanied by an initial installment payment equal to twenty five percent of the filing fee. The balance of the fee shall be paid in three additional installment payments, each in an amount equal to twenty five percent of the filing fee; and it is further  

ORDERED that when an Application to Have the Chapter 7 Filing Fee Waived is denied, and the Court’s Order on the Application to Have the Chapter 7 Filing Fee Waived grants the debtor the ability to make installment payments, the first installment payment must be paid within fourteen days of the filing date of the petition, and be in an amount equal to twenty five percent of the filing fee. The balance of the fee shall be paid in three additional installment payments each in an amount equal to twenty five percent of the filing fee.
