Hussain Case No. 99-62058, 1/4/2013

The Debtor sought an order requiring the trustee to satisfy the balance due on a student loan and trustee cross-moved to bar the Debtor from filing any further pleadings. The Debtor’s motion was denied and the trustee’s cross-motion was granted.

McPartland v. Rossi Case No. 10-1284, 2/14/2013

Plaintiffs sought a determination that the debt due from the Debtor by reason of breach of a home improvement contract was nondischargeable under 11 U.S.C. §523(a)(2)(A) for fraud.  Plaintiffs failed to carry their burden of proving that the Debtor misrepresented his experience in the home improvement business, the time of completion, or how Plaintiffs' money would be spent.
