Judge Michael B. Kaplan's Hearing Dates

Motions for Stay Relief must be scheduled to be heard within 30 days of filing (U.S.C. 11 Section 362(d).  All Chapter 7 Motions to Vacate the Automatic Stay scheduled for hearings PRIOR to the original date of the 341(a) Meeting of Creditors will be AUTOMATICALLY CONTINUED to the next available hearing date AFTER the scheduled First Meeting. The Trustee WILL NOT BE REQUIRED to file opposition papers on any stay relief motion scheduled PRIOR to the First Meeting. Trustee opposition papers WILL BE REQUIRED if the Trustee wishes to pursue an objection AFTER the original First Meeting Date. If a Creditor has cause why the Motion should be heard BEFORE the original date of the 341(a) Meeting of Creditors, the request must be made in a COVER LETTER to be attached to the Motion papers, otherwise the creditor will have been deemed to have consented to the adjourned date. NOTE: The following list may contain dates that no longer comply with notice requirements found in the Local Rules for the District of New Jersey. It is the responsibility of the e:filer to ensure proper notice. The court will reschedule improperly listed matters and the e:filer will receive a Notice of Electronic Filing indicating the correct date. It is the responsibility of the e:filer to notify all interested parties of the change. Continuous scheduling errors may result in a revocation of the e:filer's password and log-in. NOTE: Certain motions, applications and objections do not require a hearing, but the e:filer will still be presented with the Hearing Information screen. This screen can be skipped by clicking on the [Next] button. The following events do not require a hearing date to be entered by the e:filer:

• Application and Order to Show Cause
• Applications to Employ
• Application and Order Shortening Time
• Application for Compensation under $1,000.00
• Objections and Responses to matters that already have hearing dates
• Cross-Motions to matters that already have hearing dates scheduled

All motions that require notice to be sent by the court must be scheduled for a minimum of 30 days from the date of filing. Pursuant to 11 E. 6 of the Court's Administrative Procedures, where a Movant seeks the entry of an emergent order, such as an Order Shortening Time or Order to Show Cause, the movant is required to simultaneously bring such filing to the attention of Judge Kaplan's Courtroom Deputy by e-mail.
