Communication

Judge Winfield prefers parties to contact the Courtroom Deputy, Nelson Dos Santos, by telephone (973-645-4764 x2298) or regular mail. Communication by fax is not permitted except with consent of Judge Winfield. A party should contact the Courtroom Deputy to request permission to fax a document. For emergent applications, parties should notify the Courtroom Deputy. Adjournments may generally be granted by the Courtroom Deputy or Generalist. Adjournment requests regarding motions heard on Mondays are required no later than the previous Thursday at 12:00 p.m. No adjournment will be granted without the consent of all parties. Per D.N.J. LBR 9072-2, proposed forms of order are to be submitted to Judge Winfield's Chamber's email.

Telephonic appearances: Judge Winfield is amenable to telephonic appearances in accordance with the policy stated on the Court's website: www.njb.uscourts.gov. Counsel should contact the Courtroom Deputy or the Court Recorder to schedule a telephonic appearance. Any such request must be made no later than 2:00 p.m. of the court day proceeding the telephonic appearance. After receiving permission to appear telephonically, counsel must immediately schedule the telephonic appearance.

Judge Winfield prefers that telephonic appearances be scheduled through Courtcall. Counsel may arrange the Courtcall appearance by calling (866) 582-6878 no later than 3:00 p.m. on the court day prior to the hearing date. Courtcall will provide attorneys with written confirmation of the telephonic appearance and a number to call to make the appearance.

Other third-party conference providers may be used, so long as the person initiating the conference call provides the court and the other parties with the call-in number.

Attorneys may not use cell phones, speaker phones or any hands free device for a telephonic appearance.

Copies of Papers

In addition to mandatory efiling, courtesy copies of papers to Chambers are required only when there are voluminous exhibits or upon request of the Court.

Stay Relief and other Motions: Judge Winfield schedules motions on Mondays at 9:00 a.m. for Chapter 7 & 13 cases and at 10:00 a.m. for Chapter 11 cases. Judge Winfield requires appearances when motions are opposed. Motions for summary judgment must be scheduled for 2:00 p.m. on Mondays.

Parties should be guided by D.N.J. LBR 9013-1, including its provision for responsive papers and cross-motions.

First Day Motions in Complex Chapter 11 Cases: Judge Winfield directs the parties to notify the Courtroom Deputy, Diana Reaves, regarding the scheduling of all first day matters.

Summary Judgment Motions: Judge Winfield requires oral argument for summary judgment motions, unless they are unopposed.

Trial

Trial:

Pre-Trial Procedures:Parties should be guided by D.N.J. LBR 7001-1. Any variation from the local Bankruptcy Rules may only be made with the permission of Judge Winfield.

Discovery Disputes: Counsel should contact Courtroom Deputy, Diana Reaves regarding discovery disputes and any request to have them resolved by telephonic hearing or otherwise. Where possible, Judge Winfield prefers to resolve discovery disputes by conference call.

Requests to Enter Default and Default Judgment:Parties should be guided by D.N.J. LBR 7055-1. Judge Winfield reviews the adversary complaint with respect to which default judgment is requested and will schedule a proof hearing where necessary.

Other: Any notification of settlement of a matter must be formalized by a letter.

Fee Applications

Fee Applications:

Counsel should be guided by D.N.J. LBR 2016-1. Judge Winfield's fee applications are scheduled on the first and third Tuesday of the month at 2:00 p.m. They are considered on the papers, unless opposition is filed.

Reaffirmation Agreements

Reaffirmation Agreement:

Parties should be guided by 11 U.S.C. section 524 and Fed. R. Bankr.P. 4008.
