Certificate of Consent

Pursuant to Section II.F. of the Court's Administrative Procedures, incorporated into D.N.J. LBR 5005-1, consent orders must be circulated and signed conventionally. The proposed Consent Order, along with a copy of the Certificate of Consent, is emailed to the appropriate judges' email box. (Only certified CM/ECF participants may use this email channel).  The proponent must simultaneously efile the Certificate of Consent. The following instructions are for efiling the Certificate of Consent only. Do NOT upload the proposed consent order as an attachment to the Certificate of Consent, as proposed orders may only be submitted to the court via email.  

When filing an Application for Consent Order in Lieu of Motion under D.N.J. LBR 9013-1(j) the Application should be efiled, and the Proof of Service and Certificate of Consent uploaded as attachments. The proposed Consent Order must be emailed to the appropriate judges' email box, a copy of the Certificate of Consent should be included in the email for the Court's ease of reference. Signatures on Consent Orders: Pursuant to Section II.C. of the Court's Administrative Procedures, incorporated into D.N.J. LBR 5005-1, Documents that are electronically filed and require original signatures, other than that the participant ("third party signatures"), may display the name of the person signing the document, preceeded by an "/s/" and typed in the space where the signature would otherwise appear, e.g., /s/ Jane Doe.

STEP 1           Choose Adversary from main menu

STEP 2           Choose Misc. Events category

STEP 3           Enter case number; click [NEXT]

STEP 4           Select Certificate of Consent from drop down list; click [NEXT]

STEP 5           If this is a joint filing, place a check in the box and click [NEXT].  If this is not a joint filing, click [NEXT] to skip this screen.

STEP 6           Select the Party or click  Add/Create New Party

TIP - If this is the first time you are appearing on behalf of this party, you will be asked to create an association between the attorney and client on the next screen as shown below:

CAUTION: unchecking the association check box will prevent you from receiving Notices of Electronic Filing in this case.

STEP 7           Click [BROWSE] to upload the pdf document; click [NEXT]

TIP - Do not upload the consent order as an attachment to the Certificate of Consent. If no Application has been filed, you may upload the Certificate of Service as an attachment.

STEP 8          If applicable, place a check in the box Refer to an Existing Event(s) and enter the hearing date in the variable box; click [NEXT]

NOTE: If this refers to an existing event, you will be asked to select the category and then the pleading to which this Certification relates.

STEP 9         Confirm case information; click [NEXT]

STEP 10       Docket text appears. Review for accuracy; click [NEXT]

TIP - Text of docket entry cannot be modified.  If an error is found, abort the transaction and begin again.
