TRANSFER OF CLAIM

A Transfer of Claim form is available on our website under Procedural Forms.  Before starting this event, determine the claim number by clicking Reports - Claims Register.

STEP 1           Click on Bankruptcy

STEP 2           Click on Claim Actions

STEP 3           Enter the case number; click [NEXT]

STEP 4           Select Transfer of Claim from drop down menu; click [NEXT]

STEP 5           If this is a joint filing, place a check in the box and click [NEXT].  If this is not a joint filing, click [NEXT] to skip this screen.

STEP 6           Select the Party and click [NEXT] or click [ADD/CREATE NEW PARTY]

TIP - If the attorney and party have not been previously associated in this case, you will be prompted to place a check in the box.

STEP 7           Upload the .pdf document; click [NEXT]

TIP - Supporting documents such as a Certificate of Service should be uploaded as an attachment to the main pleading.

STEP 8         Click on the appropriate radio button for Transfer Type;

Enter the creditors's name in the Search for Transferee field and click Search Creditors. 

If the creditor is not found, click [CLOSE] to return to the previous screen and click [ADD NEW CREDITOR].  Enter the creditor's name and address and click [SUBMIT].

If the creditor is found and the address is correct, highlight the creditor's name and click [SELECT].

If the creditor is found and the address is incorrect, click [CLOSE] to return to the previous screen and click [ADD NEW CREDITOR].  Enter the creditor's name and address and click [SUBMIT].

STEP 9          To search for the transferor, enter the creditor's name in the Search for Transferor field and click [SEARCH CREDITORS].  You may select 3 transferrers on this screen.  Click [TRANSFER MORE CLAIMS] if necessary or click [NEXT]

STEP 10        Claim number will fill automatically once transferor has been selected.

STEP 11        Enter Amount to be transferred; click [NEXT]

STEP 12        Confirm case information; click [NEXT]

STEP 13        Docket text displays.  Review for accuracy.  If modification is necessary, abort the transaction and begin again.  Modifications cannot be made on this screen.

SAMPLE DOCKET TEXT

Transfer of Claim.  Amount to be transferred $$$$.  Transfer Agreement 3001(e) 3 Transferor: [Party] to Transferee [Party].  Filed by Test Attorney (Test Atty).
