STATEMENT IN RESPONSE TO NOTICE OF FINAL CURE PAYMENT

 

Within 21 days after service of a Notice of Final Cure Payment, the holder of the secured claim MUST file a response to the Notice.  The local form, Statement in Response to Final Cure Payment may be utilized.  The response must indicate whether 1) the holder agrees that the debtor has paid in full the amount required to cure the default on the claims, and 2) the debtor is otherwise current on all payments consistent with ยง 1322(b)(5) of the Bankruptcy code.  The Statement shall also itemize the required cure or post petition amounts, if any, that the creditor contends remain unpaid as of the date of the Statement.  The Statement shall not be subject to Rule 3001(f).

 

Determination of Final Cure Amount. The debtor or Trustee, within 21 days of service of the above Statement, may file a Motion For Determination of Final Cure Payment.

STEP 1         Choose Bankruptcy on blue menu bar

 

STEP 2         Choose Misc Events category

 

STEP 3         Enter case number; click [NEXT]

 

STEP 4         Select Statement in Response to Notice of Final Cure Payment from drop down menu and click [NEXT]

 

STEP 5         Click [NEXT] to skip the joint filing screen

 

STEP 6         Select the Party screen displays.  Select the party you represent from the list of parties; click [NEXT]

 

TIP - If the party you represent is not on the list, click the Add/Create New Party link.

 

CAUTION - If you are adding the party for the first time in the case you will be prompted to create an association between you and the party.  Failure to do so will prevent you from receiving Notices of Electronic Filing (NEF's).

 

STEP 7          Upload the PDF document; click [NEXT]

 

TIP - After navigating to your file, open it to confirm it is the file you want to upload. To do this, right click on the file name and select open from the pop up menu.

 

STEP 8          Click [NEXT] to continue

 

STEP 9          Docket text appears. Review for accuracy; modify if appropriate; click [NEXT] to submit the transaction.

 

TIP - Text of docket entry cannot be modified from this screen.  If modification is necessary use the [BACK] button on your browser to return to the screen where the error was made.  THIS IS THE LAST OPPORTUNITY TO MODIFY INFORMATION.
